THE High Court will this Thursday preside over a US$3,6 million dispute between legislator Mayor Wadyajena and business mogul Kudakwashe Tagwirei emanating from a botched truck-hire deal.

Wadyajena's company, Mayor Logistics (Pvt) Ltd, sued Tagwirei and his firm Sakunda Logistics (Pvt) Ltd for allegedly failing to remit four truck horses and tankers, prejudicing him of US$3 611 195, 24.

The matter would be heard before Justice Happias Zhou.
Wadyajena is demanding payment of US$3 611 195, 24 damages for loss of income and profit caused by defendants' unlawful possession and use of four of his trucks between July 2012 and December 2016.

The damages were being claimed at the rate of US$14 812, 12 a truck, per month which Wadyajena's company ought to have realised by hiring out the trucks monthly.

The court heard sometime in October 2016, Tagwirei acknowledged using the trucks and there was an agreement to substantiate the claim.

Tagwirei and his company were alleged to have acknowledged Wadyajena's entitlement to damages occasioned by their unlawful possession and use of the said trucks.

The parties agreed that computation and quantification of such damages would be a matter for claim and determination at a future date.

"…despite demand, the defendants have failed or neglected to pay the sum of US3 611 195, 24 as claimed by the plaintiff," Wadyajena averred.

"Defendants have unnecessarily put plaintiffs to the expense of litigation despite being fully aware of their obligations. Defendants' conduct requires censure by an order for costs on the legal practitioner and client scale."
